Its just been pointed out to me that pocketwareusa.com are selling my game Star Miner and they shouldnt be. Ive certainly never heard of the company, although I suspect that they are really Crystal Interactive, who seem to have finally gone bust.
I signed a game to this company in 1998 and havent earned a bean from them, so it looks like they have been taking the money and changing their name when their reputation got too bad.
All my emails to the new company bounce back, so definitely one to avoid there methinks.

I had the exact same thing with regard to CI.
After a while they ignored me even though I had a signed contract.

At first I couldn't find you game. I looked and looked and found nothing. Then I discovered something quite odd, that I've never seen anyone do before. http://pocketwareusa.com and http://www.pocketwareusa.com go to completely different sites. I knew it was possible to do this, but I've never seen anyone NOT make the base domain an alias to the www domain.
So anyway, I went to the www site and found it sure enough (even a screenshot on the homepage). I started looking around, and noticed something I couldn't believe. Your game is being sold on the Pocketware Mini CDs, which are being sold for $5 in retail stores like ToysRUs and Frys, and even online at Amazon. I took a quick look at Amazon and couldn't find the game CDs. All I saw were the Learning Company ones. Still, it could be something to keep an eye on.
Anyway, in order to contact them, for starters have you looked at the non www URL I mentioned above? Since it's a different site, it might have some other contact info that would be useful to you. A whois on the domain gives us:

The big question, of course, is are they licensed to sell the game. If you published with CI, CI could have licensed the game to pockerware (assuming the rights to do so were within your contract with CI). If that is the case, there really isn't much you can do to stop pocketware from selling the game. It would be a matter of figuring out how to collect the money. And its not likely to be a lot of money at only $5 retail.

You might also want to contact the other game devs of the other titles they are selling and ask them if they know anything about it.

Cliffski, you might want to go back and look at the game "Space Racers", too... It looks to be your Rocky Racers game.

Their "Space Defender" is also PomPom's "Space Tripper"... I've emailed PomPom to see if they are aware of it.
It's possible that people signed contracts that allowed for sub-licensing, in which case you have little control over where and how it turns up.

heh thats interesting, If they are doing dodgy deals then someone with pom poms clout might have more luck.
Space tripper was a big hit, I doubt they would let someone rename it.
And yes that other game is Rocky Racers....

actually I knew magnusssoft were selling it, that ones ok, they even claim to have paid me. (takes ages for it to show up in my account).
I hadnt seen the box though. cheers!
they dont sell many copies.

Mega Pinball 3D is also sold on http://www.pocketwareusa.com. I know that CI sold a similar Pinball 3D game.
